2. Eligibility and Account Registration
You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.
You may register using an email address (via magic link) or through a supported OAuth provider (currently Google and GitHub). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You must notify us promptly of any unauthorized use of your account.
If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. The organization is responsible for all activity by its members.
3. Beta Program
The Service is currently in private beta. Access requires either a beta invitation code or an approved access request.
The Service is under active development. By participating in the beta, you acknowledge and accept the following:
- The Service is provided as-is with no guarantee of availability, uptime, feature completeness, or fitness for any particular purpose. Features available today may be modified, replaced, or removed without notice.
- We do not guarantee long-term data retention during the beta. While we make reasonable efforts to preserve your data, beta infrastructure changes may require data migrations, resets, or schema changes that could affect stored content, belief states, or configuration. You should maintain your own backups of any critical data.
- APIs, SDKs, data formats, endpoints, and pricing are subject to breaking changes at any time. We will make reasonable efforts to communicate significant changes in advance, but this is not guaranteed during the beta period.
- We may revoke beta access at our discretion. Beta invitation codes may have expiration dates and usage limits.
- Service availability may be interrupted for maintenance, updates, or infrastructure changes. We do not offer uptime guarantees or service-level agreements during the beta.
- Your feedback about the Service during the beta period may be used to improve the Service without obligation or compensation to you.
When the Service transitions out of beta, we will provide advance notice and offer a reasonable migration path for existing beta users and their data.
4. Studio Service
4.1 Description
Studio is a workspace for structured thinking. It allows you to create documents, canvases, and whiteboards; engage in AI-powered conversations; and build belief states that model claims, evidence, confidence, and reasoning.
4.2 Workspaces and Collaboration
Studio organizes content into organizations, studios, and spaces. Organizations may have multiple members with different roles (owner, admin, member). Spaces within studios may have separate access controls (admin, editor, viewer).
Organization owners and administrators are responsible for managing membership and access within their organization. Invitations to join an organization are sent via email and expire after a set period.
4.3 Agent Execution
Studio may execute AI agents on your behalf in isolated sandbox environments. Agents run in ephemeral microVMs with process and filesystem isolation. Agent sessions have a maximum duration of 60 minutes and may be checkpointed for resumability.
You acknowledge that agent outputs are AI-generated and may contain errors, inaccuracies, or hallucinations. You are responsible for reviewing and validating all agent-generated content before relying on it.
5. Belief SDK
5.1 License
The Belief SDK is distributed under the Apache License, Version 2.0. You may use, modify, and distribute the SDK in accordance with the terms of that license. A copy of the Apache License is included with the SDK source code.
The SDK's open-source license governs the client-side code. Your use of the Thinkn hosted API endpoints through the SDK is governed by these Terms.
5.2 API Keys
To use the SDK with the Thinkn hosted service, you must authenticate with an API key. API keys are scoped to your user account and grant access to all spaces you are a member of.
You are responsible for keeping your API keys confidential. API keys are shown once at creation and are stored as cryptographic hashes. If you believe a key has been compromised, revoke it immediately from your account settings.
We reserve the right to revoke API keys that are used in violation of these Terms or that pose a security risk.
5.3 SDK Namespaces
The SDK allows you to define namespaces that map to workspaces within Thinkn. Namespaces are created automatically on first use and are unique per user. You are responsible for the content processed through your namespaces.
6. Your Content and Data
6.1 Ownership
You retain all ownership rights in Your Content. These Terms do not transfer any of your intellectual property rights to Thinkn.
6.2 License Grant to Thinkn
By submitting Your Content to the Service, you grant Thinkn a non-exclusive, worldwide, royalty-free license to use, process, store, reproduce, and display Your Content solely to the extent necessary to provide, maintain, and improve the Service. This license terminates when you delete Your Content or close your account, except as required for legitimate backup, audit, or legal compliance purposes.
6.3 Belief States
Belief states derived from Your Content — including extracted claims, evidence, confidence scores, and reasoning traces — are part of Your Content and subject to the same ownership and license terms.
6.4 Uploaded Files
Files you upload to a workspace are stored in cloud storage and may be processed to extract text and generate vector embeddings for search functionality. You represent that you have the right to upload any files you submit and that doing so does not violate any third-party rights.
6.5 Data Portability
You may access your belief states, reasoning traces, and audit history through the SDK's read and query methods. We are developing additional data export capabilities. For bulk data export requests, contact us at support@thinkn.ai.
6.6 Deletion
You may delete Your Content at any time through the Service. Deleted content enters a 30-day grace period before permanent removal. Audit log entries referencing deleted content are retained for up to 2 years for security and compliance purposes.
7. AI Processing
7.1 How It Works
The Service processes Your Content using third-party AI models to provide chat responses, extract beliefs, run agents, and generate analysis. Your messages, conversation history, and contextual content are sent to these AI providers as part of normal Service operation.
7.2 AI Providers
We currently use the following AI providers:
- Anthropic (Claude models) — for chat, belief extraction, agent execution, and content analysis.
- OpenAI — for alternative model selection and specific analytical tasks.
We may add, remove, or change AI providers at any time. We will update our Privacy Policy to reflect current providers.
7.3 No Guarantee of Accuracy
AI-generated content — including belief extractions, agent outputs, coherence analysis, and chat responses — is produced by statistical models and may be inaccurate, incomplete, or misleading. The Service is a tool to assist your thinking, not a source of ground truth.
You are solely responsible for evaluating and acting on AI-generated content. Do not rely on the Service for medical, legal, financial, or safety-critical decisions without independent verification.
7.4 Training
Thinkn does not use Your Content to train its own AI models. Each third-party AI provider's data practices, including whether they use API inputs for model training, are governed by their respective terms and policies.
8. Sharing and Collaboration
8.1 Share Links
You may generate share links to make specific content (documents, canvases, sessions, or whiteboards) accessible to others. Share links provide read-only access and expire after 7 days by default (maximum 30 days).
You are responsible for managing your share links. Anyone with a valid share link can view the shared content. You may revoke a share link at any time. We recommend sharing only content you are comfortable making accessible to others.
8.2 Organization Collaboration
Content within an organization's workspaces is accessible to members according to their assigned roles and permissions. Organization administrators are responsible for managing access controls appropriately.
9. Usage Limits and Rate Limits
To ensure fair use and service stability, the Service enforces the following limits:
9.1 Rate Limits
| Resource | Limit |
|---|---|
| Chat and riff messages | 60 per minute / 1,000 per day per session |
| Agent API requests | 60 per minute per user |
| SDK API requests | 60 per minute / 5,000 per day per API key |
| Tool executions | 100 per hour / 500 per day per session |
| Canvas operations | 200 per minute / 10,000 per day per canvas |
| Concurrent SSE connections | 5 per user |
These limits may change as the Service evolves. Requests that exceed rate limits will receive an HTTP 429 response.
9.2 Computational Limits
Agent sandbox sessions have a maximum duration of 60 minutes. Daily AI inference usage is capped at a per-user spending limit (currently $10.00 USD per day by default). These limits may be adjusted based on your plan or by contacting us.
10. Fees and Billing
During the beta period, the Service is available at no charge subject to the usage limits described in Section 9.
We intend to introduce paid plans in the future. AI inference costs are tracked per user based on the models invoked and tokens consumed. When paid plans are introduced, we will provide at least 30 days' notice and clearly communicate pricing, plan tiers, and any changes to usage limits.
We reserve the right to modify pricing at any time. Any pricing changes will not apply retroactively to a billing period already in progress.
11. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Upload, transmit, or process content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or connected systems.
- Interfere with or disrupt the Service, including by circumventing rate limits, authentication mechanisms, or security controls.
- Use the Service to develop competing products by systematically extracting or reverse-engineering our proprietary features, algorithms, or user interface designs.
- Use automated means (bots, scrapers, crawlers) to access the Service beyond what the SDK and documented APIs provide.
- Share or distribute API keys, or use a single account to provide service to multiple unaffiliated users or organizations.
- Misrepresent AI-generated content as human-authored where such a distinction is legally or professionally material.
- Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users' use.
We may investigate violations and may suspend or terminate your access at our discretion.
12. Intellectual Property
12.1 Thinkn's Intellectual Property
The Service, including its design, features, code (except the open-source SDK), documentation, trademarks, and all related intellectual property, is owned by Thinkn, Inc. and is protected by copyright, trademark, and other intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. All rights not expressly granted are reserved.
12.2 Open-Source Components
The Belief SDK is licensed under the Apache License 2.0. Other open-source components used in the Service are subject to their respective licenses. Nothing in these Terms restricts your rights under applicable open-source licenses.
12.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant Thinkn a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback into the Service without obligation or compensation.
13. Third-Party Services
The Service integrates with third-party services including AI providers (Anthropic, OpenAI), cloud infrastructure (Supabase, Vercel), search providers (Exa), speech services (ElevenLabs), and code hosting platforms (GitHub). Your use of these services through Thinkn is also subject to their respective terms of service:
Thinkn is not responsible for the availability, accuracy, or practices of third-party services.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, Thinkn does not warrant that:
- The Service will be uninterrupted, error-free, or available at all times.
- AI-generated content, including belief states, confidence scores, and reasoning traces, will be accurate, complete, or reliable.
- The Service will meet your specific requirements or expectations.
- Defects or errors will be corrected in any particular timeframe.
- The Service is free of viruses or other harmful components.
The Service does not provide professional advice of any kind. Content generated by the Service should not be considered a substitute for professional medical, legal, financial, or other expert advice.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THINKN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
THINKN'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO THINKN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Thinkn and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service.
- Your Content.
- Your violation of these Terms.
- Your violation of any third-party rights.
- Any content shared through share links you created.
17. Termination
17.1 By You
You may stop using the Service at any time. To close your account, contact us at support@thinkn.ai. Self-service account deletion is under development.
17.2 By Thinkn
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, non-payment (when applicable), or extended inactivity.
17.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may retain Your Content for a reasonable period to allow you to retrieve it. After that period, Your Content will be deleted in accordance with our data retention practices described in our Privacy Policy.
The following sections survive termination: Sections 6.2 (License Grant), 11 (Acceptable Use), 12 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), and 19 (General Provisions).
18. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice within the Service at least 15 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
19. General Provisions
19.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
19.2 Dispute Resolution
Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Delaware or, at the election of the claimant, remotely via videoconference.
Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
19.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
19.4 Waiver
Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
19.5 Entire Agreement
These Terms, together with our Privacy Policy and any applicable open-source licenses, constitute the entire agreement between you and Thinkn regarding the Service and supersede all prior agreements and understandings.
19.6 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. Thinkn may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all of its assets.
19.7 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
